Gentick Electronics Pty (Ltd), (“We”, “Us” or “Our” as applicable) takes great care to ensure that any submission of your personal information is kept private and not disclosed in an unauthorized manner. We respect the privacy of every person that uses our website and mobile application, including related features, products, and services (collectively the “Platform”) and we are committed to a safe online experience for our users. Although the Platform is not designed to collect substantial personal data, we feel it is important to explain what information we do collect, what we do with it and to describe the rights you may have with respect to the data. We also respects the privacy of every person who uses the services that we make available from the Platform or who engages with the Platform or us to use the services that are provided (be it through the Platform or not) (“Service” or “Services”) or whose personal information may be processed as a result of others’ use of the Services.

WHAT ARE ELECTRONIC COMMUNICATIONS PROTOCOLS AND COOKIES AND HOW DO WE USE THEM?

We may store information that we collect through cookies, log files, clear gifs, and/or third parties to create profiles of our users. A profile is stored information that we keep on individual users that detail their viewing preferences. Consequently, collected information is tied to the users’ personally identifiable information to provide offers and improve the content of the Platform for the user. This profile is used to tailor a user’s visit to the Platform, and to direct pertinent marketing promotions to them. We do not share your profile with other third parties.

Cookies

A cookie is a piece of data stored on the user’s computer tied to information about the user. Usage of a cookie is in no way linked to any personally identifiable information while on our Platform. We use both session ID cookies [and] persistent cookies. For the session ID cookie, once users close the browser, the cookie simply terminates. A persistent cookie is a small text file stored on the user’s hard drive for an extended period of time. Persistent cookies can be removed by following Internet browser help file directions.

We use cookies to enhance the user’s experience on the Platform. By setting a cookie on our Platform, users would not have to log in a password more than once, thereby saving time while on our Platform. If users reject the cookie, they may still use our Platform. The only drawback to this is that the user will be limited in some areas of our Platform. For example, the user will not be able to participate in any of our sweepstakes, contests or monthly drawings that take place. Persistent cookies enable us to track and target the interests of our users to enhance the experience on the Platform.

While we do not offer an opt-out on the Platform for cookies, browsers provide you with information and control over cookies. You can set your web browser to alert you when a cookie is being used. You can also get information on the duration of the cookie and what server your data is being returned to. You then have the opportunity to accept or reject the cookie. Additionally, you can set your browser to refuse all cookies or accept only cookies returned to the originating servers. Users can generally disable the cookie feature on their browser without affecting their ability to use the Platform, except in some cases where cookies are used as an essential security feature necessary for transaction completion.

How Do We Use Your Data?

To Engage In Transactions For Service: Your name, address, email, purchase details, and credit card/payment information may be collected and stored as part of the transaction history and may be used by us to enable us to perform the Services.

To Provide Future Service And Support. Information collected for this purpose is both contact data and information related to products and service/support requested. This information is also used to provide service, product updates, and similar notices.

To Select Content. Data may be collected to help create web site content and navigation that is most relevant and user friendly. This includes data collected as a result of site navigation, as well as data provided in forms.

To Respond To User Inquiries And Requests For Information. This data includes registrations for online newsletters, opt-in mailing lists and specific requests for further information.

To Respond To Regulators. Data is used to respond to law enforcement organizations, government officials, or third parties when compelled by subpoena, court order, or applicable law, or to report or prevent suspected fraudulent or illegal activity in the use of the Services. We will notify Customer of the information request or submission as, and if, allowed.

When You Consent to Share Information to/for Relevant Programs or Online Accounts. To provide various communities, such as resellers, with relevant product alerts and updates. These updates are related to product releases, prices, terms, special offers and associated campaigns. This data is sent when the program member signs up for the relevant program or online account.

For Gentick Electronics Pty (Ltd)’s Marketing to You. We may use information from user purchases and user-specified requirements to provide you with timely and pertinent notices regarding product releases and service developments that address your needs and specified requirements and/or which are similar to services previously purchased by the user from us.

To Use Log Files. Like most standard web site servers we use log files. This includes internet protocol (IP) addresses, browser type, internet service provider (ISP), referring/exit pages, platform type, date/time stamp, and number of clicks to analyze trends, administer the Platform, track users’ movement in the aggregate, and gather broad demographic information for aggregate use. IP addresses, etc. are not linked to personally identifiable information. We use a tracking utility called ‘ClickTracks’ that uses log files to analyze user movement.

To Use Clear Gifs. We employ a software technology called clear gifs (a.k.a. Web Beacons/Web Bugs), that help us better manage content on the Platform by informing us what content is effective. Clear gifs are tiny graphics with a unique identifier, similar in function to cookies, and are used to track the online movements of Web users. The main difference between the two is that clear gifs are invisible on the page and are much smaller, about the size of the period at the end of this sentence. Clear gifs are not tied to users’ personally identifiable information. Clear Gifs can “work with” existing cookies on a computer if they are both from the same Platform or advertising company. That means, for example, that if a person visited ‘www.companyX.com’, which uses an advertising company’s clear gif, the web site would match the clear gif’s identifier and the advertising company’s cookie ID number, to show the past online behavior for that computer. In addition, we use clear gifs in our HTML-based emails to let us know which emails have been opened by the recipients. This allows us to gauge the effectiveness of certain communications and the effectiveness of our marketing campaigns. If users would like to opt-out of these emails, please see the Opt-out section.

For Special Offers. We send all new members a welcoming email to verify password and username. Established members will occasionally receive information on products, services, special deals, and a newsletter. Out of respect for the privacy of our users we present the option to not receive these types of communications. Please see the Choice and Opt-out sections.

For Newsletters. If a user wishes to subscribe to our newsletter, we ask for contact information such as name and email address.

For Service Announcements. On rare occasions it is necessary to send out a strictly service related announcement. For instance, if our Service is temporarily suspended for maintenance we might send users an email.

For Customer Service. We may communicate with you on a regular basis to provide the Services and any other requested services, and in regards to issues relating to their account we reply via email or phone, in accordance with the users wishes.

Notwithstanding the foregoing, we will not transfer information to any of our agents, processors, or sub-processors unless we first either: (i) ascertain that the recipient is subject to an adequacy decision (such as the EU–US Data Privacy Framework, the UK Extension to the EU–US DPF, or another applicable adequacy finding); (ii) ascertain that the recipient is subject to applicable DP Laws as defined at the end of this Privacy Policy; or (iii) enter into a written agreement (including, where relevant, the European Commission's Standard Contractual Clauses, the UK International Data Transfer Agreement / Addendum, or an equivalent mechanism) requiring that the recipient provide at least the same level of privacy protection as is required under applicable data privacy laws.

DOES GENTICK ELECTRONICS PTY (LTD) COLLECT ANY FINANCIAL DATA?

No. Gentick Electronics Pty (Ltd), utilizes Google and Apple to process all financial transactions and Gentick Electronics Pty (Ltd), is not provided with any data or personal information related to your transaction.

DOES GENTICK ELECTRONICS PTY (LTD) SHARE YOUR PERSONAL DATA?

We will only share your data for the limited marketing purposes as set forth in this Privacy Policy and with other vendors for purposes of performing the Services and operation of the Platform.

WHO DOES GENTICK ELECTRONICS PTY (LTD) SHARE YOUR PERSONAL INFORMATION WITH?

We may share your data in an aggregated, de-identified manner with third-party marketing companies as set forth in this Privacy Policy. We do not share your data with any third-parties to perform the Services except that various vendors that are performing maintenance on the Site may have limited temporary access to your information. We may provide your personal information to third-party payment processors or order fulfillment vendors for purposes of providing the Services to you. We may also need to share your personal information for purposes of disclosing to law enforcement if required by law. We do not share your personal information for advertising purposes.

WHAT IS GENTICK ELECTRONICS PTY (LTD)’S LEGAL BASIS FOR SHARING YOUR PERSONAL DATA?

It is necessary for us to use your personal information to perform our obligations in accordance with any contract that we may have with you or it is in our legitimate interest or a third party’s legitimate interest to use personal information in such a way to ensure that we provide the Services in the best way that we can. We have a legitimate business interest to create business opportunities for our company in sharing aggregated demographic information with our partners and advertisers that may be based on your aggregated, de-identified personal information. This is not linked to any personally identifiable information. We also have a legitimate business interest to share your personal information with third party vendors that are necessary to fulfill any orders that you make on the Platform. We may share your location data for the legitimate purpose of providing targeting advertising to you if you consent to our use of location data.

WHAT ABOUT COLLECTION OF MINOR’S DATA?

The Service is not targeted towards, nor intended for use by, anyone under the age of 18. We do not collect personal identifying information from any person we actually know is a minor under the age of 18. In jurisdictions that set a different age of digital consent (for example, ages 13–16 under Article 8 of the GDPR depending on the EU/EEA member state, age 13 under the U.S. Children's Online Privacy Protection Act ("COPPA"), or as required under POPIA), we will not knowingly process the personal information of a child below that age without verifiable parental or guardian consent. If you believe we have inadvertently collected personal information from a child, please contact us at michael@gentick.co.za and we will take appropriate steps to delete it.

ARE THERE ANY OTHER CIRCUMSTANCES THAT MY PERSONAL INFORMATION MAY BE SHARED?

Business Transitions

In the event Gentick Electronics Pty (Ltd). goes through a business transition, such as a merger, being acquired by another company, or selling a portion of its assets, users’ personal information will, in most instances, be part of the assets transferred. Users will be notified via email prior to a change of ownership or control of their personal information. If as a result of the business transition, the users’ personally identifiable information will be used in a manner different from that stated at the time of collection they will be given choice consistent with our notification of changes section.

COMPLIANCE WITH THE PROTECTION OF PERSONAL INFORMATION ACT (POPIA)

Purpose of Compliance As a South African entity, Gentick Electronics Pty (Ltd) is committed to complying with the Protection of Personal Information Act (POPIA). POPIA sets out principles and conditions for the lawful processing of personal information and aims to protect the right to privacy while enabling the safe, free flow of information.

Scope of POPIA This section of our Privacy Policy relates to our collection, use, and disclosure of personal information of South African residents in accordance with POPIA.

Collection and Processing of Personal Information We ensure that personal information is collected and processed lawfully, reasonably, and in a manner that does not infringe on your privacy. The processing includes the collection, receipt, recording, organization, retrieval, use, and storage of your personal information. We process personal information only with your consent and as necessary to provide our services, comply with legal obligations, protect your legitimate interests, or pursue our legitimate interests. COMPLIANCE WITH THE GENERAL DATA PROTECTION REGULATION (GDPR – EU/EEA)

Scope of Compliance If you are located in the European Union (EU) or European Economic Area (EEA), Gentick Electronics Pty (Ltd) processes your personal data in accordance with Regulation (EU) 2016/679 (the General Data Protection Regulation, "GDPR") and applicable EU member state implementing legislation.

Legal Bases for Processing We rely on one or more of the following legal bases under Article 6 of the GDPR when processing your personal data: your consent (Art. 6(1)(a)); performance of a contract with you or to take steps at your request prior to entering into a contract (Art. 6(1)(b)); compliance with a legal obligation to which we are subject (Art. 6(1)(c)); protection of the vital interests of a natural person (Art. 6(1)(d)); performance of a task carried out in the public interest (Art. 6(1)(e)); or our legitimate interests, where these are not overridden by your rights and freedoms (Art. 6(1)(f)). Where we process special categories of personal data, we rely on a separate condition under Article 9 of the GDPR, typically your explicit consent.

Rights of EU/EEA Data Subjects Under the GDPR you have the right to: access your personal data and obtain a copy (Art. 15); rectify inaccurate or incomplete personal data (Art. 16); erase your personal data ("right to be forgotten") (Art. 17); restrict our processing (Art. 18); receive your personal data in a portable format (Art. 20); object to processing, including direct marketing (Art. 21); not be subject to solely automated decision-making, including profiling, that produces legal or similarly significant effects concerning you (Art. 22); and withdraw consent at any time (Art. 7(3)) without affecting the lawfulness of processing prior to withdrawal.

International Data Transfers Where we transfer personal data outside the EU/EEA to a country that has not been the subject of an adequacy decision by the European Commission, we rely on appropriate safeguards under Article 46 of the GDPR, such as the European Commission's Standard Contractual Clauses (SCCs) and supplementary measures where required following the Court of Justice judgment in Case C-311/18 (Schrems II). Supervisory Authority You have the right to lodge a complaint with the supervisory authority in the EU/EEA member state of your habitual residence, place of work, or place of an alleged infringement.

EU Representative Where Article 27 of the GDPR applies to us, we will appoint and identify an EU representative on this Privacy Policy. If no representative is identified, you may contact us using the details in the "How to Contact Us" section above.

COMPLIANCE WITH THE UK GDPR AND DATA PROTECTION ACT 2018

Scope of Compliance If you are located in the United Kingdom, we process your personal data in accordance with the UK General Data Protection Regulation ("UK GDPR") and the Data Protection Act 2018 ("DPA 2018"), together with the Privacy and Electronic Communications Regulations 2003 ("PECR") where applicable.

Rights of UK Data Subjects You have the same substantive rights as EU data subjects (set out above), exercisable against us under UK law.

International Transfers from the UK Where we transfer personal data out of the UK to a country without an adequacy regulation made by the UK Secretary of State, we rely on appropriate safeguards including the UK Information Commissioner's International Data Transfer Agreement ("IDTA") or the UK Addendum to the EU SCCs, together with any required transfer risk assessment.

Supervisory Authority You may lodge a complaint with the UK Information Commissioner's Office (ICO) at ico.org.uk.

COMPLIANCE WITH THE CALIFORNIA CONSUMER PRIVACY ACT (CCPA / CPRA)

Scope of Compliance If you are a California resident, this section applies to you under the California Consumer Privacy Act of 2018, as amended by the California Privacy Rights Act of 2020 (collectively, "CCPA/CPRA").

Categories of Personal Information Collected In the past 12 months we may have collected the categories of personal information described in the section "Why Do We Collect Your Data and What Do We Collect?" above, which include identifiers (such as name, email address, IP address), internet or other electronic network activity information, geolocation data, and commercial information. The sources, business and commercial purposes for collection, and categories of recipients are described in this Privacy Policy.

Sale and Sharing of Personal Information We do not "sell" personal information for monetary consideration, and we do not knowingly sell or share the personal information of consumers under 16 years of age. To the extent that disclosures of personal information to advertising or analytics partners may be deemed a "sale" or "sharing" for cross-context behavioral advertising under the CPRA, you have the right to opt out as set out below.

California Consumer Rights Subject to certain exceptions, you have the right to: know what personal information we collect, use, disclose, and (if applicable) sell or share; access a copy of your personal information; delete personal information we have collected from you; correct inaccurate personal information; opt out of the sale or sharing of your personal information; limit the use and disclosure of sensitive personal information; and not be discriminated against for exercising these rights.

Submitting a Request You may submit a verifiable consumer request by emailing michael@gentick.co.za. We will respond within 45 days, with one 45-day extension where reasonably necessary. We may need to verify your identity before complying with your request. You may use an authorised agent to submit a request on your behalf, in which case we may require proof of authorisation.

Shine the Light California Civil Code §1798.83 ("Shine the Light") permits California residents to request a list of third parties to whom we have disclosed personal information for those third parties' direct marketing purposes during the preceding calendar year. We do not currently disclose personal information for such purposes.

COMPLIANCE WITH OTHER U.S. STATE PRIVACY LAWS

If you are a resident of Virginia (Virginia Consumer Data Protection Act, "VCDPA"), Colorado (Colorado Privacy Act, "CPA"), Connecticut (Connecticut Data Privacy Act, "CTDPA"), Utah (Utah Consumer Privacy Act, "UCPA"), Texas (Texas Data Privacy and Security Act, "TDPSA"), Oregon (Oregon Consumer Privacy Act, "OCPA"), Montana (Montana Consumer Data Privacy Act, "MCDPA"), Delaware, Iowa, Indiana, Tennessee, New Jersey, New Hampshire, Minnesota, Maryland, or another U.S. state with a comprehensive consumer privacy law, you may have rights similar to those described above for California, including the rights to access, correct (where applicable), delete, and obtain a portable copy of your personal data, and to opt out of targeted advertising, the sale of personal data, and certain profiling that produces legal or similarly significant effects. Where applicable law provides an appeals mechanism for our refusal to act on a request, we will inform you of that mechanism in our response. COMPLIANCE WITH THE PERSONAL INFORMATION PROTECTION AND ELECTRONIC DOCUMENTS ACT (PIPEDA – CANADA)

If you are located in Canada, we process your personal information in accordance with the federal Personal Information Protection and Electronic Documents Act ("PIPEDA") and any applicable substantially similar provincial legislation, including Quebec's Act respecting the protection of personal information in the private sector (as amended by Law 25), Alberta's Personal Information Protection Act ("PIPA Alberta"), and British Columbia's Personal Information Protection Act ("PIPA BC").

We collect, use, and disclose personal information only for purposes that a reasonable person would consider appropriate in the circumstances, and we obtain meaningful (and, where required, express) consent. You have the right to access and correct your personal information, to withdraw consent (subject to legal or contractual restrictions), and, where applicable under Quebec Law 25, to data portability and to be informed of automated decision-making. Complaints regarding our handling of personal information may be directed to the Office of the Privacy Commissioner of Canada (priv.gc.ca) or the relevant provincial commissioner (including the Commission d'accès à l'information du Québec).

COMPLIANCE WITH THE AUSTRALIAN PRIVACY ACT 1988 AND THE AUSTRALIAN PRIVACY PRINCIPLES (APPs)

If you are located in Australia, we handle your personal information in accordance with the Privacy Act 1988 (Cth) and the thirteen Australian Privacy Principles (APPs) set out in Schedule 1 of that Act, together with the Notifiable Data Breaches scheme. You have the right to access and correct your personal information and to make a complaint about how we handle your personal information. COMPLIANCE WITH AFRICAN DATA PROTECTION FRAMEWORKS

In addition to South Africa's Protection of Personal Information Act ("POPIA") set out above, where users are located in other African jurisdictions we will, as applicable, comply with local data protection legislation, including (without limitation): Nigeria's Nigeria Data Protection Act 2023; Kenya's Data Protection Act 2019; Ghana's Data Protection Act 2012 (Act 843); Egypt's Law No. 151 of 2020 on the Protection of Personal Data; Mauritius's Data Protection Act 2017; Rwanda's Law No. 058/2021 on the Protection of Personal Data and Privacy; Uganda's Data Protection and Privacy Act 2019; Botswana's Data Protection Act 2018; Zimbabwe's Data Protection Act (Chapter 11:24); and the African Union Convention on Cyber Security and Personal Data Protection (Malabo Convention) where ratified by your country of residence. INTERNATIONAL DATA TRANSFERS – GENERAL

The Platform is operated from South Africa. Personal information may be processed in, and transferred to, jurisdictions other than the one in which you reside, including South Africa, the United States, the European Union, the United Kingdom, and other countries in which we or our service providers operate. These jurisdictions may have data protection laws that differ from those in your country. Where required by applicable law, we put in place appropriate safeguards for cross-border transfers, including (without limitation) the European Commission's Standard Contractual Clauses, the UK IDTA or UK Addendum, the POPIA Section 72 transfer conditions, the PIPEDA accountability principle for transfers, the APP 8 cross-border disclosure framework, and equivalent mechanisms under other applicable laws. By using the Platform, you acknowledge that your personal information may be transferred and processed internationally as described in this Privacy Policy.

HOW DO WE OBTAIN YOUR CONSENT?

WHAT ARE MY RIGHTS WITH RESPECT TO GENTICK ELECTRONICS PTY (LTD)’S USE OF MY PERSONAL INFORMATION?

Choice/Opt-out

Each of our users are given the opportunity to ‘opt-out’ of having their information used for purposes not directly related to the Platform at the point where we may ask for your personal information. For example, our website has an ‘opt-out’ mechanism so users who registered can keep their email address off of our lists.

Users who no longer wish to receive our newsletter and promotional communications may opt-out of receiving these communications by changing it on their profile.

Users of our Platform are always notified when their information is being collected by any outside parties. We do this so our users can make an informed choice as to whether or not they should proceed with services that require an outside party.

Correcting/Updating/Deleting/Deactivating Personal Information

This is up to user's choice as it will help users to keep track of maintainance. Any use of photos with your likeness is subject to the terms of our Terms of Use.
